Sexual Harresment Law  कल्पना (काल्पनिक नाम) कुछ दिनों से काफी चुप-चुप रहने लगी थी। ये बात उसके ऑफिस में सबने नोटिस की। ऑफिस में उसकी बेस्ट फ्रेंड ने कई बार उससे ये जानने की कोशिश। कल्पना ने जो अपनी सहेली को बताया वो हैरान करने वाला था। उसके साथ प्रोजेक्ट में काम करने वाला राहुल नाम का लड़का अक्सर उसे गंदी नीयत से छूता रहता है। उसने राहुल को कई बार मना करने की कोशिश की, लेकिन उसने उल्टा कल्पना को ही धमकी दी कि अगर उसने ऑफिस में किसी को कुछ भी बताया तो वो उसे बदनाम कर देगा। उसके बाद तो कल्पना जैसे चुप सी हो गई और सब सहती रही।

Sexual Harresment Law कल्पना राहुल की हमारे देश प्रदेश और आसपास कमी नहीं है। हम कितने भी आधुनिक क्यों न हो जाएं लेकिन हमारे देश में सेक्सुअल हैरेसमेंट के मामले बढ़ते ही जा रहे हैं। कई बार तो लड़कियां ये समझ ही नहीं पातीं कि उनके साथ यौन उत्पीड़न यानी सेक्सुअल हैरेसमेंट हुआ है। सबसे पहले जान लीजिए सेक्सुअल हैरसमेंट यानी यौन उत्पीड़न होता क्या है। किसी भी तरह की सेक्सुअल एक्टिविटी यानी यौन गतिविधी जो बिना सहमति के हो वो सेक्सुअल हैरसमेंट कहलाती है। वैसे तो इस दायरे में लड़के-लड़कियां दोनों आते हैं, लेकिन अक्सर लड़कियों के साथ सेक्सुअल हैरेसमेंट ज्यादा देखा जाता है।

Sexual Harresment Law किसी लड़की को बिना उसकी मर्जी के गंदी नीयत से छूना, गंदे मैसेज भेजना, जबरदस्ती किस करना, गंदी बातें करना, लड़की को देखकर भद्दी टिप्पणी करना, सीटी बजाना, उसकी सेक्सुअल लाइफ के बारे में जानने की कोशिश करना, फोन पर या सामने उससे भद्दे मजाक करना, ये सारी बातें सेक्सुअल हैरेसमेंट में आती हैं। हमारे देश में सेक्सुअल हरैसमेंट के जितने केस दर्ज होते हैं उससे कहीं ज्यादा छुपाए जाते हैं। वजह होती है लड़की का डर या घबराहट या फिर समाज की वजह से सामने न आना। बिल्कुल वैसे ही जैसे निशा संजय के खिलाफ किसी को बताने से कतरा रही थी।

Sexual Harresment Law हमारे समाज में अक्सर लड़कियों को इस तरह के मामलों में सामने आने से रोका जाता है। हालांकि पिछले कुछ समय में थोड़ा बदलाव जरूर आया है। कई महिलाएं इस तरह की घटनाओं के खिलाफ खुलकर सामने आती हैं। कई बार प्रदर्शन भी होते हैं। मी टू जैसे कैम्पेन के तहत भी कई लड़कियों ने अपने खिलाफ हुए यौन उत्पीड़न को सबके सामने रखा, लेकिन ऐसे मामले बेहद कम होते हैं और वजह होती है इससे जुड़े कानून की जानकारी न होना।

Sexual Harresment Law साल 2013 से पहले भारतीय संविधान की धारा 354 के तहत कोई भी अगर सेक्सुअल हैरेसमेंट के खिलाफ थाने में शिकायत दर्ज करवाता था और आरोप सिद्ध होते थे तो उसे आईपीसी की धारा के तहत एक साल से लेकर 5 साल की सजा हो सकती थी, चाहे मामला कोई भी हो। 2013 के बाद इस कानून में काफी बदलाव किए गए हैं। अब सेक्सुअल हैरेसमेंट को चार धाराओं में बांटा गया है। धारा- 354-A, धारा- 354-B, धारा- 354-C, धारा- 354-D।
क्या कहती है धारा 354-A?

इसके तहत वो मामले आएंगे जिसमें किसी महिला के साथ जबरन शारीरिक संबंध बनाने की कोशिश की गई हो, उसे गंदी नीयत से टच किया गया हो, अश्लील मैसेज भेजे गए हो या फिर गंदे कमेंट किए गए हों।अश्लील वीडियो दिखाने को भी इसी धारा के तहत लिया गया है। ऐसे आरोपों के साबित होने पर तीन साल की सजा और जुर्माना भी लगाया जा सकता है।
धारा- 354-B के तहत 7 साल तक की सजा

धारा 354-B के तहत अगर कोई शख्स किसी महिला को जबरदस्ती कपड़े उतारने पर मजबूर करता है, या फिर उसपर कपड़े उतारने का किसी भी तरह से दवाब बनाता है या फिर जबरदस्ती उसके कपड़े उतारता है तो उसे इस धारा अंतर्गत 5 से लेकर 7 साल तक की सजा हो सकती है। ये धारा नॉन बेलएबल यानी गैर जमानती है।

Sexual Harresment Law 354-C के तहत ऐसे केस आते हैं जब किसी महिला का अश्लील वीडियो बनाया जाता है।इसके अलावा महिला के किसी प्राइवेट काम को पब्लिकली फैलाना भी इस धारा के तहत शामिल किया गया है। लड़की ऐसे आरोपों के खिलाफ शिकायत दर्ज करवा सकती है और दोषी पाए जाने पर आरोपी को 3 साल की सजा का प्रावधान है।
धारा 34-D के तहत 3 साल की मिनिमम सजा

34-D में स्टालकिंग यानी जबरदस्ती लड़की का पीछा करना शामिल है। इसके अलावा लड़की की मर्जी के बिना कोई उससे जबरदस्ती कॉनटेक्ट बनाए रखने की कोशिश करता है तो भी लड़की इस धारा के तहत अपनी शिकायत दर्ज करवा सकती है। इस धारा के तहत केस पर आरोपी को 3 से लेकर 5 साल की सजा मिल सकती है और साथ ही जुर्माना भी लगाया जा सकता है।
