Vulgarity in FIR अक्सर शिकायतकर्ता  जब थाने में रिपोर्ट दर्ज़ करवाता है तो उसकी भाषा शैली ऎसी होती है कि आपको भी पढ़ , सुन कर अजीब लगेगा। मामले में बढ़ा चढ़ा कर रोज़मर्रा के अमर्यादित शब्दों और बोलचाल की भाषा में लोग एफआईआर लिखवाते हैं। लेकिन जब मर्यादा के पार बात चली जाए तो वही होता है जो माननीय Allahabad high court न्यायालय ने अपनी टिप्पणी में कहा है..

  • vulgarity in FIR इलाहाबाद हाई कोर्ट ने वैवाहिक विवाद के एक मामले में दर्ज प्राथमिकी में इस्तेमाल की गई भाषा पर सख्त टिप्पणी की है। अदालत ने कहा है कि एफआईआर तो संज्ञेय अपराध के मामले में सिर्फ सूचना दर्ज कराने का एक जरिया है, जिसके आधार पर कार्रवाई शुरू की जा सके। लेकिन, इसकी भाषा किसी भी सूरत में अमर्यादित नहीं होनी चाहिए। कोर्ट ने यह भी कहा कि दहेज उत्पीड़न के मामलों में कई बार बढ़ा-चढ़ाकर आरोप लगा दिए जाते हैं, लेकिन पुलिस को सामान्य मामलों में कूलिंग पीरियड के दौरान किसी की भी गिरफ्तारी से बचना चाहिए

  • vulgarity in FIR इलाहाबाद हाई कोर्ट के सामने एक ऐसा वैवाहिक विवाद आया, जिसमें अदालत को बहुत ही सख्त टिप्पणी करनी पड़ गई। शिकायत करने वाली महिला ने अपने पति, ससुर और देवर पर यौन उत्पीड़न और दहेज के लिए दबाव डालने का आरोप लगाया था। उसने एफआईआर में अपनी सास का भी नाम दर्ज करवाया था। मामला उत्तर प्रदेश के हापुड़ जिले के पिलखुआ थाने का है, जहां वह महिला रहती है। एफआईआर में आरोपियों पर आईपीसी की धारा 498-ए, 307 (हत्या की कोशिश), 120-बी (आपराधिक साजिश) और 323 (जानबूझकर नुकसान) के तहत मामला दर्ज किया गया था।

  • vulgarity in FIR अपनी शिकायत में महिला ने आरोप लगाया था कि उसके ससुर ने उससे यौन सुख की मांग की थी। जबकि, अपने देवर के खिलाफ उसने ‘शारीरिक तौर पर उसे बर्बाद’ करने की कोशिश का आरोप लगाया था। यहां तक कि महिला ने अपनी सास और ननद पर भी गर्भपात के लिए दबाव डालने का आरोप लगाया था। एफआईआर में उसने अपने पति पर अप्राकृतिक और जबरन यौन संबंध बनाने का भी आरोप लगाया था। महिला का आरोप था कि उससे लगातार अतिरिक्त दहेज की मांग की जा रही थी और इनकार करने पर उसकी पिटाई की गई और अपमानित किया गया।

  • vulgarity in FIR एफआईआर में दर्ज भाषा इलाहाबाद हाई कोर्ट के जज को बहुत ही अटपटी लगी। जस्टिस राहुल चतुर्वेदी ने अपनी टिप्पणी में कहा, ‘प्राथमिकी वह स्थान है जहां सूचना देने वाला संज्ञेय अपराध के बारे में राज्य तंत्र को लामबंद करने के लिए जानकारी देता है। यह कई पॉर्न साहित्य नहीं है, जहां चित्रमय विवरण दिया जाना चाहिए।’ सत्र न्यायालय में सुनवाई के दौरा इस मामले की जांच में आरोपों क निराधार पाया गया था। इसके बाद याचिकाकर्ताओं ने हाई कोर्ट में समीक्षा याचिका डाला था।
